Terms of service

1. Who we are
This website, jam174.com, is run by Andrea Sophia Dobos-Harnwell, a sole trader trading as JAM.174 ("we", "us", "our"). Our address is 120 High Street, Sutton, Ely, Cambridgeshire, CB6 2NW, United Kingdom. You can contact us by email at hello@jam174.com or by phone on 07399 522645.
2. These terms
These terms apply to every order you place on this website. Please read them before you order. They sit alongside our Refund policy, Shipping policy and Privacy policy. If you are buying as a consumer, nothing in these terms affects your legal rights.
3. Our products
Every item is made to order by our fulfilment partners after you place your order. We try to show products accurately, but colours can look slightly different on different screens, and because items are printed or embroidered individually, small variations in print position are normal. Please check the size guide on each product page before ordering.
4. Placing an order
When you place an order, you'll receive an email confirming we've received it. A contract between you and us is formed when we send that order confirmation email. If we can't accept your order, for example because a product is unavailable or there's an obvious pricing error, we'll tell you and won't charge you, or we'll refund you in full if payment has already been taken.
5. Prices and payment
All prices are in pounds sterling (GBP). JAM.174 is not VAT registered, so no VAT is added to our prices. UK delivery is free on orders over £50. Under £50, delivery is charged at a flat rate of £5.99 per order. From time to time we run free-shipping promotions, and the discount is shown at checkout when one applies. The total cost, including delivery, is always shown at checkout before you pay. Payment is taken when you place your order. If we find an obvious error in the price of an item you've ordered, we'll contact you before dispatch and you can choose to go ahead at the correct price or cancel for a full refund.
6. Delivery
We currently deliver to addresses in the United Kingdom only. Estimated production and delivery times are set out in our Shipping policy. They are estimates, but if your order doesn't arrive within 45 days of ordering, you can cancel it and receive a full refund. Your order is our responsibility until it is delivered to the address you gave us, and it becomes yours once it's delivered and we've received full payment.
7. Your right to cancel
If you are a consumer, you have the legal right to cancel your order within 14 days of the day you receive it, for any reason, even though items are made to order. To cancel, email hello@jam174.com with your order number. How returns and refunds work, including who pays return postage, is set out in our Refund policy. We'll refund you within 14 days of receiving the item back, or of receiving proof that you've posted it, whichever is sooner, including the standard delivery charge you paid.
8. Faulty or incorrect items
We are legally required to supply products that are of satisfactory quality, fit for purpose and as described. If your item is faulty, damaged or not what you ordered, your rights under the Consumer Rights Act 2015 include the right to reject it for a full refund within 30 days of delivery, and after that the right to a repair or replacement, or a partial or full refund. Please email us with your order number and a photo of the problem and we'll put it right. We cover the return postage for faulty or incorrect items.
9. Discount codes and promotions
Discount codes can only be used once per order, can't be exchanged for cash, and may have their own conditions, such as an expiry date or a limited number of uses, which will be stated when the code is offered.
10. Our designs and content
All designs, graphics, logos, photographs and text on this website belong to JAM.174 or are used with permission, and are protected by copyright and other intellectual property laws. You may not copy, reproduce or use them for any commercial purpose without our written permission. Buying a product gives you ownership of that item, not any rights in its design.
11. Using our website
You must not use this website for anything unlawful, attempt to interfere with its security or operation, or use automated tools to scrape or copy its content. We may suspend access to the website if these terms are broken. We try to keep the website available and accurate, but we can't guarantee it will always be uninterrupted or error-free.
12. Our responsibility to you
If we break these terms, we are responsible for loss or damage you suffer that is a foreseeable result of that. Loss or damage is foreseeable if it's obvious it would happen or if we both knew it might happen when the contract was made. We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights as a consumer, including your rights in relation to faulty products. Our products are for personal use, and we are not responsible for any loss of profit or business if you use them for business purposes.
13. Events outside our control
We are not responsible for delays caused by events outside our reasonable control, such as courier disruption, extreme weather or problems at our fulfilment partner. If this happens, we'll let you know, and if the delay is significant you can cancel your order for a full refund.
14. Your personal information
We only use your personal information as set out in our Privacy policy. JAM.174 is registered with the Information Commissioner's Office (registration reference ZC236295).
15. Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the ones shown on this page at the time you placed it.
16. Complaints
If you're unhappy with anything, please email hello@jam174.com and we'll aim to reply within 5 working days. If we can't resolve your complaint, you can get free, independent advice from Citizens Advice Consumer Service on 0808 223 1133.
17. Law and courts
These terms are governed by the law of England and Wales. If you live in England or Wales, you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can bring legal proceedings in the courts of either your home nation or England and Wales.
